In the Turner v. Commr. case, the petitioner, a real estate investor, purchased 29.3 acres of unimproved land in a historical overlay district, 15.04 acres of which were located within a designated floodplain. The petitioner, claiming that he was entitled to develop up to 62 residences on smaller lots, executed a deed to Fairfax County purporting to limit development of the property to 30 residences. On their 1999 federal income tax return, the petitioners claimed a contribution deduction for a qualified conservation easement under Section 170(h)(1). The Tax Court held that the petitioner did not make a contribution of a qualified conservation easement under Section 170(h)(1), because the attempted grant did not satisfy the conservation purposes required under Section 170(h)(4)(A). Ella Dorothy Turner, 86, of Prince George, Va., passed away Thursday, Dec. 11, 2008 at the Hopewell Health Care Center. She was preceded in death by her husband Edward M. Turner Sr. Mrs. Turner was born in 1922 in Hertford, N.C. She had four children, one deceased son, Edward Turner Jr., and three living children, Dorothy T. Borkey of Colorado, David L. Turner of Charlotte, N.C. and Michael I. Turner of Prince George, Va. Also surviving is a sister, Jessie Mae Hollowell of Manteo, N.C.

NORFOLK - Joyce Denise Turner, 60, of the 2500 block of Waverly Way, passed away March 11, 2008. Denise was born in Norfolk, the daughter of the late Lacey Fields and Mary Elizabeth Nixon-Fields.
