Criminal Procedure Reach-in searches
Constitutional criminal procedure needs to be reformed to better integrate criminal and procedural laws with constitutional principles that are truly applicable. Constitutional law's history in the criminal context is much shorter than the history of constitutional law in general. The Warren Court established expansive, yet often inconsistent, interpretations of the Fourth, Fifth and Sixth Amendments. Some of their doctrines, such as the exclusionary rule, have no basis in the Constitution. Reforms should focus on procedural efficiency, deterrence and avoiding windfalls for the guilty.
The Advisory Committee on Rules of Criminal Procedure will hold a two-day meeting. The meeting will be open to public observation but not participation.
