It was the last teaching day of the school year and I was rushing through my lecture, OAfter the Civil War.O I had to get to the Election of 1876 before the bell rang or my students would miss what they needed to understand why Reconstruction collapsed. I made a HobsonOs choice. I would skip over the administration of Ulysses Grant in order to get to Rutherford Hayes.
As a result, my eighth grade students heard nothing about the Credit Mobilier scandal, the Panic of 1873 or GrantOs efforts to advance Native American and African American rights, all important events of the era.

History has pictured the great railroad-driven19th century settlement of the deserts, mountains and flatlands of the American West as a mixed blessing.
The railroad barons of the era were devious and knew how to cut ethical corners, but they achieved the noble end result of bringing our then-very-young nation together, much to our economic and cultural benefit to this day.

In the late nineteenth and early twentieth centuries, literature that reflected changing attitudes toward sexuality, religion, marriage, and government fell victim to the Comstock Act and related state laws on obscenity. Among the earliest individuals convicted was Dr. Edward Bliss Foote for a brochure that promoted birth control, and, he and his son, Dr. Edward Bond Foote, challenged obscenity legislation in Congress, state legislatures, and courts and also offered personal assistance to defendants in free speech cases. From 1872 to 1915, they waged a campaign against obscenity prosecutions that they considered unfair and advocated the right to freely discuss reform issues of the day, many of them sex-related. This study documents the Footes' free speech work, which brought them into c...

Shareholders in corporations face two very different types of governance problems: expropriation by controlling shareholders or managers; and expropriation by greedy rulers or, more generally, by the state. The problem is that the more successful investors are in protecting their capital from the grabbing hand of the state, the less they are able to call upon the state to protect it from the grabbing hand of corporate insiders. Conversely, the more investors are able to call upon government to restrain insiders, the more they are vulnerable to expropriation by the state. Although the terms of this tradeoff have changed over time as modern democratic polities replaced absolutist monarchies, both types of threats are still very much with us.
