  • The Missouri Court of Appeals Western District narrowly affirmed the conviction of a man on a child molestation charge, drawing a sharp dissent from four members of the court en banc. The five-judge majority found that the attorney for the defendant had failed to object to testimony from a criminal investigator who said the child victim's statements were credible. Precedent generally holds that the credibility of a witness is up to the jury to decide. On appeal, the defendant, identified in the opinion as D.W.N., said the trial judge should have stopped the testimony.
