  • Last week, we summarized the main governmental and private approaches to preserving and legislating our built environment. Covenants, conditions and restrictions; zoning codes; building departments; the National Historic Register; the Utah State Historical Society and historical districts regulate some of what we can and cannot do in our neighborhoods.

  • A case involving a condominium owner in California and her property insurance disputes over water damage is detailed. The condo development was managed by its homeowners association, which had established a declaration of covenants, conditions and restrictions (CC&Rs) stating that the association was responsible for obtaining liability and property insurance for the entire development. When the interior of the woman's condo suffered water damage that resulted from a water leak in a neighboring unit, both her and the association's insurance companies denied the claim. The results of trial court and appeals court hearings are presented. Language in the condominium's CC&Rs is evaluated for determining damage liability.
