The Sheriff Court Rules Council's function is to review the procedure and practice in civil proceedings in the Sheriff Court. The Court of Session then reviews the Council's proposals from which it will modify existing rules in the form of a statutory instrument known as an "Act of Sederunt". On the Aug 18, 2009, a new Act of Sederunt was introduced which could cause creditors difficulty in recovering monies properly due to them where the contractual agreement is regulated by the Consumer Credit Act 1974. This is because the Rules of Court will be altered for all relevant claims commencing on Dec 1, 2009. Whilst implementation of the change has been postponed it is still being considered.
