State and federal law did not require a pro rata reduction, to account for attorneys' fees and costs, from the amount that the Department of Job and Family Services would be reimbursed for payments for medical expenses when a Medicaid beneficiary obtains a recovery from a third-party tortfeasor. The existing statutory process under R.C. 5101.58(G)(2) provides for a reduction to account for attorneys' fees and costs and ensures that the Department of Job and Family Services will not obtain excess recovery.
