This article presents several national court decisions in Europe. The Cour de Cassation, France's Supreme Court, recently confirmed and refined the scope of the Kompetenz-Kompetenz of arbitrators in France. The Supreme Court quashed the appeals court decision, ruling that there was no finding that an arbitration clause was either manifestly void or manifestly inapplicable. The Belgian Supreme Court has recently refused to annul an arbitral award despite the arbitrators' apparent misapplication of a key provision of the relevant contract Africa Industrial Services v Polytra, Court of Cassation. In Lesotho Highlands Development Authority v Impregilo SpA et al, the English House of Lords ruled that an arbitral award should not be reviewed by the English courts simply because the tribunal had made an error of law, since such an error does not in itself mean that the arbitrators were acting in excess of their powers. PARIS (HedgeWorld.com) - Trying to remove the only legal blemish on his long career, hedge fund manager George Soros appealed his conviction on insider trading charges by a French court in 2002. On Thursday, the Paris Court of Appeal upheld the lower court's guilty verdict, as well as a 2.2 million euro (US$2.8 million) fine levied in the case. That means Mr. Soros, who has maintained he did nothing wrong, is still on the hook for the fine, at least until France's supreme court, the Cour de Cassation, has a chance to review the case. Mr. Soros' attorneys said after the Thursday ruling that he would appeal the case there.
