The U.S. Attorneys office in Charleston and the Kanawha County Prosecutors office have cooperated many times over the years. Now the two offices are designating a particular person to make that happen. Maryclaire Akers, who has been chief of staff for the county prosecutors office, will be special assistant U.S. attorney to the Southern District of West Virginia. Akers is no stranger to her new job. She has been splitting her time between the two offices for the past few weeks. But U.S. Attorney Booth Goodwin and Kanawha Prosecutor Mark Plants made the move official Friday. Akers retains her prosecuting responsibilities in Plants office, including that of felony cases and prosecuting Shawn Lester, the Charleston man accused in the 2003 sniper style shootings of three Kanawha County resi...

Administrative Hospital Construction New Rule Certificate Of NeedWhere St. John's Mercy Health System challenged a rule promulgated by the Missouri Health Facilities Review Committee that exempts new hospitals costing less than $1 million from obtaining a certificate of need, the challenge to the rule was a controversy that was ripe for review after the MHFRC applied the rule to determine that no certificate was needed for Patients First Community Hospital, and St. John's also established standing for its challenge, and the Supreme Court finds that the new hospital rule is consistent with the certificate-of-need law and the commission was within its authority to promulgate the rule. Judgment is affirmed as modified. Mercy Hospitals East Communities v. Missouri Health Facilities Review ...

In fact, [SCOTT BRISTER]'s administration of the 14th Court of Appeals was the best advertisement for his anti-plaintiff credentials. Efficiency was the watchword while Brister was the chief judge, and plaintiffs' attorneys learned to dread appearing before him. When the Houston Chronicle reported that plaintiffs did especially poorly in the 14th Court of Appeals, winning reversals in only 4 percent of cases, Brister agreed that the figure was "pretty low" but said "it just happened to be the cases we got that year." Others have a different explanation: that Brister was on a mission to overturn jury verdicts and to rein in what he considered to be an out of control tort system in Texas. In 1998, Brister wrote a now infamous dissent in a case called Schindler Elevator Corporation v. Ande...

The following Putnam County-related news and feature items were among those published in recent editions of The Charleston Gazette, Charleston Daily Mail, Saturday Gazette-Mail and Sunday Gazette- Mail:
Mayses say they would do it all again Johnny and Donna Mays say they would do it all the same way again. The Mayses were acquitted of felony child concealment charges June 8 after a three-day trial in Putnam County Circuit Court. They admitted they took their granddaughter, Sara Dawson, then 3, and fled Feb. 10, 2010, to Arizona after a family court judge revoked their custody and gave custody to their daughter and her estranged husband. The childs mother, Carrie Essman, was a long-distance truck driver and had previously relinquished custody of her daughter to her parents. The Mayses we...
