Administrative Hospital Construction New Rule Certificate Of NeedWhere St. John's Mercy Health System challenged a rule promulgated by the Missouri Health Facilities Review Committee that exempts new hospitals costing less than $1 million from obtaining a certificate of need, the challenge to the rule was a controversy that was ripe for review after the MHFRC applied the rule to determine that no certificate was needed for Patients First Community Hospital, and St. John's also established standing for its challenge, and the Supreme Court finds that the new hospital rule is consistent with the certificate-of-need law and the commission was within its authority to promulgate the rule.
