While there was ample evidence for a trial judge to uphold the revocation of an accused drunk driver's license, the Western District said the defendant didn't really get his day in court so it drove the case back to the trial judge.
In Jonathan R. Shumaker v. Director of Revenue, the Nevada Police Department got a tip around 8 p.m. April 17, 2004, that Shumaker left the AM Vet's bar intoxicated. Some 20 minutes later the cops got another call that Shumaker crashed his white Ford Ranger on Route W north of the Nevada city limits. A Nevada police officer arrived on the scene at 8:29 p.m. and Missouri State Highway Patrol Trooper James Wilde showed up at 8:49 p.m. where he found Shumaker already cuffed and sitting next to the Ranger. Apparently he was being uncooperative and had tried to l...

In political theory, the problem of the other is usually taken to be the problem of the foreigner, the immigrant, and the refugee. In response to the problem so conceived, political theorists write books about the ethics and politics of multiculturalism, alien suffrage, the conflicting claims of cosmopolitanism and nationalism, internationalism and democracy, the politics of gender or sexuality in patriarchal societies. If the other is dead, however, democratic societies try to find answers on how to relate to those others who are no longer around to make claims that need to be adjudicated or to those killed in the process of settlement or colonization. Here, Honnig takes a look at two texts that deal with this question, the film Sophie's Choice and the play Antigone, written over 2000 ...

The appellants guilty plea waived her ability to raise a statute-of-limitation issue on appeal, and plain error does not exist. The record fails to portray ineffective assistance of counsel in connection with the statute-of-limitation issue. The trial court did not abuse its discretion in imposing a one-year prison sentence. Judgment affirmed.

The prosecutor's theory is that the graduate student's death occurred during a sexual assault. Trace evidence was found under her fingernails and a sperm was also found on a sheet. No claim is being made that the sperm or the trace evidence belongs to [Darryl Littlejohn] or a "John Doe" defendant. She was last seen at The Falls, a watering hole.
I am unable to find an explanation for Kings County District Attorney Charles Hynes and Police Commissioner Raymond Kelly holding a joint press conference about the indictment before Littlejohn was arraigned in Brooklyn Supreme Court. It was obviously done to compromise Littlejohn's right to a fair trial. This alone should subject them to a criminal investigation.
