A tax services company could not enforce an arbitration clause in its customer agreement when it was sued for violating federal consumer protection law, a U.S. District Court in Pennsylvania has ruled. TaxMasters is a company that provides services to consumers who have tax problems with the IRS. The plaintiff in this case engaged TaxMasters' services by calling the company's toll-free number. At that time, TaxMasters charged a $500 "flat fee" to the plaintiff's credit card with the understanding that the plaintiff would be billed additional installment payments.
