DES MOINES - Iowa Attorney General Tom Miller has filed a consumer fraud lawsuit against a Des Moines company, accusing it of misleading people about the percentage of donations kept by the business. Miller announced at a news conference Wednesday that he also is joining prosecutors in 31 other states in suing a Milwaukee company, Community Support, Inc. Miller alleges that when the company made calls into Iowa, it misrepresented its location and the percentage of donations that would go to charity.
A state consumer protection and unfair trade practices act doesn't provide a cause of action against a lawyer for fraudulent disbursement of settlement proceeds, the Pennsylvania Supreme Court has ruled in reversing a judgment for the attorney's clients. The attorney improperly converted $95,000 in settlement proceeds from his clients' personal injury case by depositing it into a court fund in connection with his own divorce. The clients sued, alleging fraud and violation of the state unfair trade and consumer protection law.
For more than 10 months, Thomas Calcagni has been acting director of the New Jersey Division of Consumer Affairs, awaiting state Senate confirmation to remove the "acting" modifier.
