HACKENSACK -- A school for Bible and religious study will soon move into a vacant building on Moore Street. The Board of Adjustment on Thursday night voted that The Israelite Church of God in Christ, based in Manhattan, doesn't need a use variance to occupy the building it has leased since 2007. It determined that because the structure had been used as a school since the 1970s, the church's proposal for the property is a preexisting non-conforming use.

Trial courts judgment affirming the decision of the City to deny property owner his variance requests affirmed. Trial court did not err when it denied property owners request to expand the record because the transcript contained the Citys findings of fact and the trial court considered the constitutionality of the ordinances. Property owner failed to demonstrate that his property was protected as pre-existing non-conforming use and failed to demonstrate practical difficulties. As a result, the Citys decision to deny his application was not arbitrary, capricious, or unreasonable.

Trial court did not err in enforcing a townships zoning resolution forbidding the establishment of junk yards when, properly interpreted, the townships zoning resolution forbade the establishment of new junk yards, and the townships zoning resolution does not conflict with R.C. 4737.07. The landowners also failed to demonstrate their use of the land as a junk yard was a pre-existing non-conforming use. Trial court did not err in enjoining the landowners from continuing the nuisance on their property, including the removal of debris other than junk motor vehicles.
