Twelfth Survey of White Collar Crime
Federal criminal laws designed to prevent attempts to influence public officers or misuse public positions are focused on bribery and various forms of conflict of interest. Bribery is proven by showing that a benefit accrued to a public official with corrupt intent was intended to influence that official in carrying out an official act. The series of conflict of interest provisions found in federal law encompass post-employment activities, limitations placed on the duties of officials, acts involving personal financial gain and unauthorized compensation.

A township supervisor in Washington County violated the state Ethics Act in 2007 and 2008, the Pennsylvania State Ethics Commission announced on Tuesday.
Ralph Barbisch, a supervisor in East Finley, violated the conflict of interest provision of the act by engaging in discussion with his fellow supervisors that led to their awarding nearly $60,000 in contracts to Rudy Barbisch Remodeling, a business he has owned for 30 years.

Act 44 of 2009 was signed into law by Gov Edward G. Rendell on Sep 18, 2009. This act amends the Municipal Pension Plan Funding Standard and Recovery Act, and is intended to provide short-term fiscal relief to local governments operating public pension plans. This article will not focus on the actuarial tools included in the law, but will instead concentrate on the new conduct and disclosure standards for professional service contracts applicable to municipal pension systems. These changes were enacted to create greater transparency and to be proactive in Pennsylvania in response to the actions of several investment firms that improperly used political influence in New York and California. The act contains required disclosures and conflict-of-interest provisions.
