In accordance with Section 610(b)(2) of the Millennium Challenge Act of 2003 (Pub. L. 108-199, Division D), the Millennium Challenge Corporation (MCC) is publishing a summary and the complete text of the Millennium Challenge Compact between the United States of America, acting through the Millennium Challenge Corporation, and the Republic of Indonesia. Representatives of the United States Government and the Republic of Indonesia executed the Compact documents on November 19, 2011.

This study examines two multilateral initiatives, the World Health Organization's Framework Convention on Tobacco Control (FCTC) and the United Nations Secretary-General's Global Compact. These are two efforts to engage transnational corporations in the development process and in the articulation of a set of multilateral rules of engagement regarding good corporate behavior. The FCTC is more stringent and proscriptive, seeking to regulate corporate behavior. The second is an invitation to transnational corporations (TNCs) to cooperate voluntarily. The relative success of the two approaches is contingent on meeting seven parameters of legitimacy, and ultimately on the legal standing of the mechanism.

The US Constitution expressly prohibits US states from entering into any Treaty, Alliance, or Confederation. Another provision -- the so-called Compact Clause -- prohibits states from entering into any Agreement or Compact with another State, or with a foreign Power absent congressional consent. The Compact Clause requires congressional consent for both foreign-state agreements (FSA) and interstate agreements. But the Supreme Court has interpreted the interstate textual prohibition loosely, authorizing the states to conclude whole categories of agreements with no congressional consent whatsoever. The purpose of this notice is to announce a meeting of the National Crime Prevention and Privacy Compact Council (Council) created by the National Crime Prevention and Privacy Compact Act of 1998 (Compact). Thus far, the Federal Government and 29 states are parties to the Compact which governs the exchange of criminal history records for licensing, employment, and similar purposes. The Compact also provides a legal framework for the establishment of a cooperative federal-state system to exchange such records.
