The IRS appears to have overstepped its authority in issuing Revenue Ruling 94-47, which equates the regular place of business standard for deduction of daily business travel expenses with the principal place of business standard for home offices. The ruling was issued in response to the Tax Court's ruling in Walker v. Commissioner. The Tax Court had found that expenses incurred traveling to multiple work sites were deductible even though the taxpayer did not qualify for the home office deduction. Taxpayers can challenge IRS authority or claim that travel was outside the metropolitan area.
