As the Oklahoma City market enters the fourth quarter of 2009, the commercial real estate market appears to be picking up pace both in terms of leasing and sales activity. During the third quarter, activity was a bit of a mixed bag in the city as sales activity slowed, but leasing activity remained relatively stable. To gain a better understanding of the current state of market conditions and what can be expected over the next three months, the following is a summary of market trends observed during third-quarter research.
- Sales activity declined in almost every category of commercial space during the third quarter. Office and apartment sales experienced a sizable decrease in sales activity compared to the first and second quarters. The decrease was attributed to the typical seasonal...

Recently, leasing has been prominent in the press due to the Air Force's recent ill-fated attempt to obtain the use of Boeing re-fueling tankers. Forgotten is that, in the early 1980's, a highly controversial Navy long-term leasing program of Maritime Prepositioned Ships had a different result. However, an unintended consequence of the Navy's success was that future government leases were practically eliminated. This research examines the issues and parties involved in this unprecedented creative and innovative leasing program for ships used by the Navy's Military Sealift Command. While the analysis concludes that the Navy's leasing program was successful and cost effective, laws and policies were changed so that long-term leasing is no longer viable for the strategic financing of milit...

Now that best practices have developed with respect to the leasing of integrated systems of hardware and software and some reported court cases have addressed the issues associated with software leasing, it is an opportune time for the equipment leasing and legal professions to address possible statutory reform. The benefits to equipment lessors would include: 1. establishing a clear right to terminate the software license upon a breach of the lease; 2. clarifying the rights of a lessor with respect to software in the event of a lessee bankruptcy, and in particular clarifying that payments for the use of software sublicensed under a finance lease will be treated in the same manner as rental payments for the use of the leased equipment; and 3. clarifying the definition of "lease" so tha...
