  • AUGUSTA - Citing recurring violations of law by President Bush over the last several years, Wisconsin Sen. Russ Feingold told delegates attending the Maine Democratic State Convention on Saturday that the chief executive's domestic and foreign policies warrant a congressional investigation and probable censure. Feingold, a potential Democratic presidential candidate himself in 2008, said he was unsure whether it was "appropriate" for the country to "actually go through the impeachment of a president." He was certain, however, that Bush's actions were exactly what the framers of the U.S. Constitution had in mind when they included high crimes and misdemeanors as impeachable offenses to remove the president, vice president and all civil officers of the United States.

  • Democratic cries for Attorney General Alberto Gonzales' head have turned from strident demands for his resignation to deep-voiced bellowing about impeachment. A Cabinet member can, indeed be impeached; same for "all civil officers of the United States," according to the Constitution. But it's been 130-odd years since such a thing happened: Secretary of War William Belknap, part of the corrupt Republican administration of Ulysses Grant, was the kind of kickback-taker who'd do many a New Mexico politician proud. He skedaddled before the House of Representatives could issue its articles of impeachment, but the process went on; the Senate, however, couldn't come up with the two- thirds vote it would have taken to convict him.

In Part I, this Article frames the phenomenon of impeachment as judicial selection as a tactic of constitutional hardball, i.e., the framework suggested by Professor Mark Tushnet for understanding how parties or movements secure rapid change between constitutional orders.6 Part I also discusses several of the prominent instances of resort to this tactic, including the Jeffersonian, Nixonian, and Christian Coalition impeachments or threats of impeachment.
