Normally, a plaintiff chooses to institute an action in the jurisdiction that he or she assumes to be the most advantageous to his or her interests. This choice, however, may be resisted by the application of the doctrine of forum non conveniens. The doctrine of forum non conveniens refers to the discretionary power exercised by courts in the common law world to decline jurisdiction over a matter, despite having jurisdiction simpliciter, where the court is of the opinion that the matter may be more appropriately tried elsewhere.
