- Analyzing Refusal-to-Deal Cases Under Brooke Group's Predatory Pricing Test: The Tenth Circuit Misses the Mark in Christy Sports, Llc V. Deer Valley Resort Co.
In Christy Sports LLC v. Deer Valley Resort Co, the Tenth Circuit held that Deer Valley Resort Co (Deer Valley) did not have a duty to deal with Christy Sports LLC (Christy Sports), a snow ski rental company, and that it did not violate Section 2 of the Sherman Act (Section 2) when it began to exercise a restrictive covenant after many years of non-enforcement. Relying on earlier Tenth Circuit and US Supreme Court decisions, the Tenth Circuit held that Deer Valley and Christy Sports did not enjoy a relationship sufficient to bind Deer Valley to continue dealing with Christy Sports. The decision attempted to draw the boundaries for Section 2 refusal-to-deal monopolization claims based on a business relationship rule. A sports store may continue to rent skis from its Deer Valley shop while the store and ski resort battle it out in court, a federal judge decided. S. District Judge Dale Kimball in late December denied Deer Valley Resort Co.'s request for a preliminary injunction against Christy Sports LLC.

- Park City Ski Shop Christy Sports Ordered to Stop Rentals
SALT LAKE CITY -- A federal court judge has banned a Park City ski shop from renting skis at its Deer Valley location for five years. S. District Judge Clark Waddoups ordered that Christy Sports LLC be prohibited from using any portion of its Deer Valley property for ski rental and from making or arranging any ski rentals without the advance written consent of Deer Valley Resort Co.
