Why should children suffer when family courts let custody battles languish? A child-custody case before Santa Fe's First District Court for nearly three years shows how a policy recommended by the court's own staff hampers a judge's ability to resolve disputes. The result is a disastrous status quo.
The legal process in custody disputes at first seems sensible. Upon the parents' separation, a psychologist on the court staff establishes a temporary child-visitation schedule. Then, if mediation fails, Mom and Dad enter full-scale custody evaluation. A second psychologist recommends to the judge a permanent schedule. Judges generally adopt the recommendation as a court order. Ordinarily the entire process takes three months.
