The author recently found himself in a situation where one of his cashiers had banked a check received from a customer in respect of a termination invoice. The problem was that the termination invoice was for L5,000 and the check was for only L1,500. This is where the disputes began. For months the author tried to obtain payment -- to the point where he even agreed to meet the customer on the M25 for a 'without prejudice' discussion regarding his account. He still refused to pay the invoice and the author had no other alternative than to issue his claim at the local County Court on Aug 6, 2009. The court agreed that the payment the author received could not have been accepted in full and final settlement, as intended by the defendant, but only as a payment on account.
