  • Understanding the process In a Chapter 7 case, the debtor files a bankruptcy petition and accompanying "schedules" that lay out their debts, assets and exemptions (more on this in breakout boxes on Page 8), and the case is assigned to a trustee. The trustee uses a lot of the same tools we use - reviewing the court documents the debtor has filed (called schedules) and searching public records such as property records, vehicle registrations, airplane registrations and corporate filings. [...] keep in mind that every state has "exemption" items that debtors can keep (with a judge's approval), which usually includes up to a certain amount in equity in a house, a car, wedding ring, clothing, household goods, etc.

  • Chapter 7 debtors could not claim homestead exemptions under a state law that is bankruptcy-specific, the 6th Circuit Bankruptcy Appellate Panel has ruled in reversing judgment. The appeal addressed the exemptions claimed by two Michigan debtors in separate bankruptcy cases. In each case, the debtors claimed homestead exemptions under a Michigan law that is available only to state residents who have filed for bankruptcy.

  • Bankruptcy: Exemptions - Untimely Objection - Bad Faith Where a trustee in a Chapter 7 case did not timely object to the homestead exemptions claimed by the debtor, the bankruptcy court erred in sustaining his later objections to the exemptions and the court also clearly erred in finding that the trustee met his burden of proving that the debtor claimed his exemptions in bad faith, so as to allow the trustee's late objections.

  • A bankruptcy trustee's failure to object to Chapter 7 debtors' claimed exemption regarding their one-half interest in a hunting cabin removed the property in its entirety from the bankruptcy estate, the 6th Circuit Bankruptcy Appellate Panel has ruled.
