A 63-year-old Westmoreland County man with HIV has been waiting 11 months for the state to determine whether he qualifies for an in- home care program that would help him battle the illness, according to a federal lawsuit filed yesterday in Philadelphia. Thomas Doe," five other people and the Center for Independent Living of Central Pennsylvania filed the class-action lawsuit to force the state Department of Public Welfare to start meeting a federally mandated deadline for determining whether people qualify for several Medical Assistance waiver programs run by the state's Office of Long-Term Living.
