Document management systems for complex litigation should be developed carefully since work product potentially be determined to be discoverable. Case law is somewhat unsettled as to the discoverability of a database index, document management system, or other similar computer data, although in most instances, such systems have been held to be protected as privileged work product. Attorneys need to weigh the particular circumstances and systems involved in order to assess potential discoverability.
