Deputy Public Defender Susan Israel argued in a motion, based on Penal Code section 995, that evidence presented by prosecutors at a November 2007 preliminary hearing was not sufficient to hold Thomson for trial on three special circumstances, Israel said.

In 1997 the American Bar Association called for a moratorium on executions until procedures were adopted that "(1) ensure that death penalty cases are administered fairly and impartially, in accordance with due process, and (2) minimize the risk that innocent persons may be executed" (ABA, 1997).
