• Gambling, Greyhounds, and Gay Marriage: How the Iowa Supreme Court Can Use the Rational-Basis Test to Address Varnum v. Brien

In the 2007 case Varnum v. Brien, a Polk County, Iowa judge ordered the state of Iowa to begin processing marriage licenses for same-sex couples. One of the rationales for striking down the gay-marriage ban was that it failed to pass rational-basis review. If the Iowa Supreme Court chooses to uphold the ruling, it should choose to apply rational basis "with teeth," a form of scrutiny that has appeared in U.S. Supreme Court cases where the court suspected invidious legislative motives were at work. Applyingthis test would most accurately follow U.S. Supreme Court precedent and would be a wise tactical move in handling such a volatile issue, leaving open future legislative and judicial avenues for addressing gay marriage.

• Maryland Court of Appeals: Mva Can Use Expunged Records

An expungement of the public record of drunken-driving convictions after 10 years does not prevent the Maryland Motor Vehicle Administration from retaining a "confidential" record of those convictions for licensing purposes, Maryland's top court said Monday. The Court of Appeals' decision upheld the MVA's denial, without a hearing, of Thomas P. Headen's application to renew his driver's license in 2006.

• Napolitano: Agents Can Use Lethal Force

Department of Homeland Security Secretary Janet Napolitano told a congressional panel Wednesday that U.S. Border Patrol Agent Brian Terry and his fellow agents were not under orders to refrain from using lethal force in a December gunbattle near the Mexican border that resulted in Mr. Terry's death. Testifying to the Senate Judiciary Committee, Miss Napolitano said agents are allowed to use lethal force "if you are under threat of serious injury or death." She said she herself had asked whether the four agents involved in the Dec. 14 shootout with bandits on the border in Arizona had their hands tied by orders, and she said the answer was "absolutely not.
