In 1953, Congress enacted Public Law 280 (PL-280) to solve the problem of lawlessness and inadequate fora on tribal lands, and transferred jurisdiction over Indian matters to courts in designated states. While these states have virtually unlimited jurisdiction over criminal matters on tribal lands, jurisdiction over civil matters has been significantly limited. In California v. Cabazon Band of Mission Indians, the Supreme Court drew a distinction between laws that are criminal/prohibitory and those that are civil/regulatory. States have jurisdiction in the former, but not the latter. The line between criminal/prohibitory and civil/regulatory, however, has been less than clear in the state and lower federal courts. Like the fruit and vegetables grown on nearby farms, the bald and threadbare tires that First Nation Recovery Inc. grinds into "crumb rubber" are a commodity, and like every commodity, the price per pound can change by the day.
The market for crumb rubber, which is used in some types of asphalt, is down 30 percent to 40 percent from just a couple of years ago, forcing First Nation, based in Mecca, Calif., owned and operated by the Cabazon Band of Mission Indians, to scramble for other ways to make money.
