Volunteer firefighters again are sounding alarms about their workers compensation coverage. Steep rate increases are on hold as a committee formed by Gov. Joe Manchin spends the next year looking for solutions. But the crisis has taken another twist. Leaders of the West Virginia State Firemens Association now say they are losing broad form liability coverage, and they are threatening to stop answering calls. The group held a press conference Monday at the site of the fallen firefighters memorial at the state Capitol. Brickstreet Mutual Insurance Co., a private company that replaced the former Workers Compensation Commission four years ago, has been the sole provider of coverage for the departments. It had been required to maintain existing rates for the departments until this July 1. Th...

Insurers traditionally compete on price, service and products. Service, unfortunately, often wanes and price competition often is more destructive than helpful. Growing numbers of insurers are beginning to market a type of coverage that falls into the above category -- broad form property damage for completed operations. Because its scope was widely misunderstood among the insurance community, not to speak of consumers, the Insurance Services Office (ISO) and its predecessors issued memoranda explaining this coverage's application for both ongoing and completed operations. For purposes of completed operations, it is the exception to the your work exclusion of the standard ISO CGL policy that is important. To the extent admitted insurers are offering these endorsements for an additional ...

Given today's business constraints, it is encouraging to see so many producers inquiring about insurance coverage issues. Available since 1954, broad form property damage coverage is difficult to understand. Part of the problem in gaining a better understanding of this coverage is that it is created by an exception to the so-called "damage to property" and "damage to your work" exclusions of standard ISO commercial general liability forms. Although liability insurance appears to be a fertile ground for coverage disputes, the resolution of disputes over property insurance sometimes can be just as perplexing to producers and their insureds. Producers cannot be faulted when insurance products, particularly traditional ones, are found by the courts not to be payable in the event of loss, cl...

Those who lead corporations and those who sit on boards have come to rely on directors and officers (D&O) policies for personal liability protection. But with the uncertainty that is a by-product of today's economic turmoil, it may be time to ask if traditional D&O insurance is the complete coverage that these high-level executives can count on when things go awry. Not all D&O insurance is alike; different policies have different exclusions. But there are instances where some D&O policies may leave gaps in coverage for non-indemnifiable claims. Broad-form D&O provides an extra layer of assurance because it cannot be rescinded and is specifically designed to take care of the lack of indemnification that occurs when exclusions are invoked.

The trial court did not err in overruling the appellants motions for judgment notwithstanding the verdict and for a new trial. The record contains evidence from which the trier of fact reasonably could have concluded that the appellees satisfied their fiduciary duty to recommend proper insurance coverage. Judgment affirmed.

An increasing number of Americans are transferring personal ownership of residential property to trusts, limited liability corporations, limited liability partnerships, and other entities designed to protect assets or take advantage of favorable tax treatment. This article focuses on the need to properly structure the insurance policy that is used to protect the majority of residential properties -- the common homeowner insurance policy. Although often overlooked, the very broad liability coverage provided by a homeowner insurance policy serves as a critical form of asset protection. To avoid potentially disastrous gaps in coverage, individuals and their advisors must take steps to ensure that insurance policies are structured to protect the interests of all parties that have an insurab...

The Manufacturers Output Policy (MOP) was originally developed as an inland marine product for the automobile industry. It was designed to cover stock during production as the vehicles passed through different plants, continuing while the vehicles were in transit and even at the dealership. The MOP covered the vehicle as long as the named insured had a financial interest in the vehicle. The MOP has evolved from a focused stock-only inland marine product for the auto industry into an extremely broad commercial property coverage form with a unique rating structure. Rating should always be a major consideration. The MOP, Commercial Output Program and Capital Assets Policy rating systems are relatively similar. This rating technique is based on experience of the risk, major industry minimum...
