Regarding the plaintiff's motion for a bifurcated trial on the issues of liability and damages in a personal injury action, bifurcation is normally not granted where the injuries sustained by the plaintiff have an important bearing on the issue of liability and are probative in determining how the accident occurred. However, in Betty Booker v. K-Mart Corp. and Benderson Development Co., Inc., Acting Buffalo City Court Judge Philip M. Marshall granted the plaintiff's motion for bifurcation. The first trial will address: 1) whether the area where the accident occurred was reasonably safe, and 2) whether the defendants were negligent in failing to keep the area in a reasonable safe condition.
