Berkshire Life Insurance Co conducted a survey to identify its real customers as part of the implementation of a quality assurance program in the company's customer service division. The Massachusetts mutual life insurer designated its internal audit department to spearhead the initiative by determining the quality of customer service being provided. The audit process was classified into five separate categories, namely, audit planning; auditor professionalism; performance of audits; reporting of results; and the department's response to ad hoc requests for assistance. A life insurance company is bound by its litigation decision to put all its eggs in the federal court's ERISA basket, and thereby preclude liability on state-law claims, the 4th U.S. Circuit Court of Appeals has held. The decision affirms the $1.3 million judgment in favor of two doctors who claim an agent from the Berkshire Life Insurance Co. mismanaged their pension plans by rapidly churning assets, failing to diversify investments, and overloading the plan with low- yielding life insurance policies from Berkshire.

Government statistics show that disability insurance covers about half the workers in the US, roughly the same amount as in 1986. The penetration statistics, from the federal Bureau of Labor Statistics, are not good, said Drew King, president of JHA, a disability reinsurance and research firm in Portland, ME. Each year, JHA surveys the vast majority of disability writers and reports on statistics and trends.
