A study examines whether an estate tax charitable deduction is normatively justified, and if so, what it should look like. Each common rationale for the tax supports some type of charitable deduction but the normative case for an unlimited deduction is weak. At best, the argument that the estate tax enhances the overall progressivity of the US tax system taken as a whole, and that charitable transfers should not count toward one's ability to pay, justifies an unlimited charitable deduction. All other rationales for the estate tax, standing alone, suggest that the deduction should be limited in some manner (depending on the rationale used to justify the tax).
