This essay provides an elementary, unified introduction to the models of market institutions that go beyond the competitive model of pricetaking behavior on both sides of the market. Several models of market institutions that govern price determination are explored and compared, including contracting, posted prices, bilateral bargaining, middlemen, and auctions. While equilibrium models still do not capture the full possibilities for market behavior, modeling specific market institutions reduces the level of abstraction inherent in the standard competitive model.

The Department of Labor (the Department) is amending its regulations governing the certification of the employment of nonimmigrant workers in temporary or seasonal non-agricultural employment and the enforcement of the obligations applicable to employers of such nonimmigrant workers. This Final Rule revises the process by which employers obtain a temporary labor certification from the Department for use in petitioning the Department of Homeland Security (DHS) to employ a nonimmigrant worker in H-2B status. This article uses three recent multi-district litigations (MDL) that produced massive settlements -- Guidant ($240 million), Vioxx ($4.85 billion), and Zyprexa ($700 million) -- to study the emerging quasi-class action approach to MDL management. This approach has four components: 1. judicial selection of lead attorneys, 2. judicial control of lead attorneys' compensation, 3. forced fee transfers from non-lead lawyers to cover lead attorneys' fees, and 4. judicial reduction of non-lead lawyers' fees to save claimants money. In this article we present ethnographic evidence from China and the UK to show that the state's migration discourse is not simply a dominant force imposed externally by the state on migrants, but is itself shaped by migrant strategies. These strategies lead to migratory, employment and survival practices that in turn produce the social phenomena (bogus asylum seeking, an informal labour market, illegal border crossing) that originally informed and justified the discourse itself.
