Sure. I think there can be silver linings in some of the challenges we face. Difficult times often result in new business models that are more focused, cohesive, efficient and responsive. Challenges give a real opportunity for companies to strengthen teamwork and resolve. It's also important to remember that clients are also facing many of the same challenges we are. The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 added Bankruptcy Code Section 1102(b)(3) to require that a creditors' committee grant access to information to, and solicit comments about the case from, creditors whose interests the committee represents. Under Bankruptcy Code Section 1102, the US Trustee has the authority to appoint an official unsecured creditors committee in a Chapter II case. The committee usually consists of the debtor's largest unsecured creditors. Many other bankruptcy courts have routinely approved information sharing and solicitation protocols containing some or all of the requirements contained in the Refco order.
