The due process approach to managing prosecutorial discretion has not worked and results which are fair and consistent would be more likely to flow from public accountability and economic restraints than from judicial controls on prosecutors. Thus, the prosecutor and the state budgetary agency should collect criminal justice data and justify the resources' use to the people. Budgetary choices would go back to the state legislature and local prosecutors would be more responsible to the people. Prosecutorial control would result from financial accountability and review by the people.
