WASHINGTON -- Federal prosecutors investigating the smuggling of nuclear technology disclosed Friday that a South African businessman has pleaded guilty to arranging illegal exports of American-made equipment both to Pakistan and its regional rival, India. Asher Karni, an Israeli who lives in South Africa, entered the guilty plea in September and has been cooperating with investigators, prosecutors said. The prosecutors kept the proceeding secret until Friday, however, when they unsealed the plea agreement and charges they have brought against Humayun Khan, an Islamabad businessman with long-standing ties to Pakistan's military. Khan is said to be Karni's partner.
Antitrust law's tying doctrine is based upon the faulty economic assumption that market power is the primary determinant of forcing and upon normative assumptions regarding the purposes of antitrust law. The US Supreme Court's modified per se rule and the Chicago School's allocative efficiency approach do not withstand empirical analysis. New Institutional Economics presents a better approach which recognizes the existence of ties without antecedent market power and without forcing.

An Israeli businessman accused of being a middleman in the nuclear black market worked to supply not only Pakistan but also its archrival India, court records indicate. South Africa-based Asher Karni faces felony charges of exporting nuclear bomb triggers to Pakistan. Court files in the case also include e-mail exchanges between Mr. Karni and an Indian businessman who was trying secretly to buy material for two Indian rocket factories.
