As part of the settlement agreement, the parties' names are confidential. The wreck happened around 5 p.m. April 8, 2007, when a car carrying three people crossed a train track near Excelsior Springs, a rural area in western Missouri. The crossing had red warning lights, but no crossing arm to block traffic.
