Utahn , the mega-savant who helped inspire Dustin Hoffman's character in the 1988 motion picture "Rain Man," died recently of an apparent heart attack. Peek, considered a genius in about 15 different subjects, was 58 years old.

The trial court lacked authority to convert Officer Stanley’s motion for judgment on the pleadings pursuant to Civ. R. 12(C) to a motion for summary judgment. Moreover, appellant was clearly prejudiced by the trial court’s failure to provide notice that appellee’s motion for judgment on the pleadings would be converted into a motion for summary judgment. Trial court’s conversion of motion, however, was harmless error. After de novo review of appellant’s complaint, it is apparent that appellee was entitled to judgment on the pleadings. Appellee is entitled to immunity for governmental employees pursuant to R.C. § 2744.03(A)(6).
