An employer did not violate the Family and Medical Leave Act when it prorated a partner's annual bonus to account for his taking FMLA leave, the 3rd Circuit has ruled.
The plaintiff took eight weeks of short-term disability leave under FMLA. When he returned, the employer did not award him a full annual bonus under its partnership plan, but instead gave him a prorated amount. The plaintiff sued, arguing that the employer illegally interfered with his FMLA rights.

The Defense Department is already preparing to absorb at least $450 billion in cuts. If Congress doesn't enact those reductions, the Budget Control Act automatically imposes about $500 billion of additional cuts over 10 years. Locally, some of Wright-Patterson's 27,000 jobs -- 18,000 of which are civilian -- could disappear, and its $5 billion annual economic impact could shrink.
