One of the central questions surrounding the 2008 presidential election is the role of race in shaping electoral choice among non-Hispanic whites, and whether race played an equivalent role among Hispanics, whose willingness to vote for an African American candidate was raised as an uncertainty during the primary campaign. Discrimination against transgender individuals in housing is pervasive. Nonetheless, American jurisprudence has not explicitly addressed whether there are legal protections available to transgender individuals who are the targets of housing discrimination. This Note argues that courts should utilize a broad and literal understanding of the Fair Housing Act's prohibition against discrimination on the basis of "sex," thereby recognizing that animus towards an individual's sex and his or her expression thereof, is, by its very terms, discrimination on account of "sex." In so doing, courts will find that transgender housing discrimination constitutes actionable "sex" discrimination within the meaning of the Fair Housing Act.

In Lautsi v. Italy, a chamber of the European Court on Human Rights (ECHR) banned the display of the cross in school classrooms, arguing that such a display was a violation of religious freedom and of a parent's right to educate his children. In addition, the court awarded the petitioner 5,000 euros in nonpecuniary damages. Whether the unusual verdict was motivated by animus or disdain toward religion in general, or against the Catholic Church in particular, is uncertain. The decision did, however, imply an obligation to impose strict secularism in Europe.

The U.S. Court of Appeals for the Second Circuit earlier this month vacated and reversed the grant of summary judgment as to the sufficiency of the causal connection between the protected activity and the elimination of petitioner Faul's full-time position, and whether a rescinded seven-day suspension constituted an adverse employment action. (Faul v. Potter, 09-0173-cv, Summary Order, Dec. 9).
The Second Circuit disagreed with the district court's pretext analysis, which concluded Faul failed to adduce sufficient causal nexus between her protected activity and the U.S. Postal Service's decision to eliminate her full-time position.
