Interpretation of the US Constitution as a living document that changes with history might lead to the startling conclusion that Pres. Bill Clinton is not qualified to hold the office. Although the amount-in-controversy requirement for diversity jurisdiction has been adjusted upward to reflect the effect of inflation, the minimum age requirements for office have not been adjusted to reflect increased life expectancies. Were the Presidential age requirement adjusted, Clinton, Al Gore, and Newt Gingrich would all be too young, and President pro tempore Sen. Strom Thurmond would be President.

Defendants are allowed to remove a case to federal court if the amount in controversy exceeds $50,000 and involves persons not from the same state. However, application of this diversity jurisdiction rule is inconsistent as to at what point the 30 day time limit for deciding to remove begins. Decisions have held both that the time limit begins when the defense is aware that the amount in controversy will be more than $50,000 and that it begins when an initial pleading involving that amount is received. No firm decision has been made and so attorneys must follow developing case law.
