Interpretation of the US Constitution as a living document that changes with history might lead to the startling conclusion that Pres. Bill Clinton is not qualified to hold the office. Although the amount-in-controversy requirement for diversity jurisdiction has been adjusted upward to reflect the effect of inflation, the minimum age requirements for office have not been adjusted to reflect increased life expectancies. The wrongful death claim a farmer's widow filed in state court against a tractor manufacturer was properly removed to federal court, the 10th Circuit has ruled. The widow claimed that the tractor's defectively designed circuitry forced her husband to bypass it, which was a common occurrence for other owners of the same model tractor. The manufacturer had previously provided warning stickers and safety kits to owners, and the tractor at issue had the sticker attached. The tractor lurched forward and killed the farmer.
The manufacturer removed the case to federal court based on diversity and the fact that the amount in controversy exceeded $75,000.

Defendants are allowed to remove a case to federal court if the amount in controversy exceeds $50,000 and involves persons not from the same state. However, application of this diversity jurisdiction rule is inconsistent as to at what point the 30 day time limit for deciding to remove begins. Decisions have held both that the time limit begins when the defense is aware that the amount in controversy will be more than $50,000 and that it begins when an initial pleading involving that amount is received. No firm decision has been made and so attorneys must follow developing case law.
