• State's 'Bad-Check' Contractor May Be Liable Under Fair Debt Act, Rules 11th Circuit

A state contractor hired to obtain restitution for victims of bad checks wasn't protected by the Eleventh Amendment from Fair Debt Act claims, the 11th Circuit has ruled in reversing a summary judgment for the contractor. Pursuant to state law, the Florida attorney's office hired an independent contractor to recover restitution for victims of bad checks. The agreement included an indemnity clause by which the contractor agreed to protect the state from all claims and losses resulting from its activities. The contractor sent out letters to bad check writers which threatened criminal prosecution by the state.
