  • Re: Decision in ACLU v. Alvarez -- Illinois Eavesdropping Law Reversed CHICAGO, May 8, 2012 /PRNewswire-USNewswire/ -- Today, the U.S. Court of Appeals for the Seventh Circuit ruled for the American Civil Liberties Union of Illinois in a case involving Illinois' controversial eavesdropping law. The ACLU is asking the federal court to block the Cook County State's Attorney from prosecuting ACLU staff for recording police officers performing their public duties in a public place. The recordings would take place as part of the ACLU's long time practice of monitoring police practices on the streets of Chicago. The information gathered by the ACLU of Illinois would be used as part of its advocacy for changes in police practices in the City. The Illinois eavesdropping law has been the subject...

  • CHICAGO, Oct. 15 /PRNewswire-USNewswire/ -- Earlier this morning, the U.S. Court of Appeals for the Seventh Circuit issued a divided ruling upholding Illinois' mandatory moment of silence law. The law requires all Illinois public schools to begin the school day with a moment of silence "for silent prayer or for silent reflection on the anticipated activities of the day." In January 2009, a U.S. District Court found the law to be unconstitutional. Today's ruling reverses that decision. The following statement can be attributed to ACLU of Illinois Senior Staff Counsel Adam Schwartz: The American Civil Liberties Union of Illinois is disappointed that this divided appellate court panel today gave its endorsement to a statewide law that coerces children to pray in our public schools. In the ...

  • SPRINGFIELD - The Illinois State Police on Tuesday denied any racial bias in deciding when to ask permission to search cars during traffic stops and defended the searches as an effective law- enforcement tool. But the American Civil Liberties Union of Illinois said state police ducked the basic question of why troopers are more likely to seek permission to search the cars of black and Hispanic drivers than of white drivers, even though searches of white drivers more often reveal contraband.

  • CHICAGO, March 29 /PRNewswire-USNewswire/ -- Cook County Circuit Court Judge Daniel A. Riley, lamenting that the Illinois Parental Notice of Abortion Act was an unfortunate law that would harm teens at risk of abuse, nonetheless granted a motion by the State of Illinois to dismiss a lawsuit brought by the ACLU of Illinois challenging the Act as violative of the state Constitution. However, the Judge also granted an order sought by the ACLU of Illinois and the State of Illinois to continue the temporary restraining order in the case until the ACLU of Illinois is able to appeal Judge Riley's decision. This means that the law will not be enforced until the appeals court can consider the matter. Judge Riley recognized that the Illinois Constitution, like its federal counterpart, protects th...

  • CHICAGO, Jan. 17, 2012 /PRNewswire-USNewswire/ -- The American Civil Liberties Union of Illinois today called on members of the Chicago City Council to reject a series of proposed changes to ordinances that add unnecessary burdens to individuals and organizations seeking to speak out on a host of public policy matters. The ordinances were proposed by the Emanuel Administration late last year, and were first announced as temporary measures to cover the period of the G8 and NATO meetings, scheduled for May 2012 in the city. After the first of the year, the Mayor confirmed that most of the provisions are permanent, creating even more concern about the addition of new barriers to free expression in Chicago beyond this year's events.

  • CHICAGO, Oct. 27, 2011 /PRNewswire-USNewswire/ -- Chicago officials have failed to deploy police equitably across the City's many diverse neighborhoods, resulting in disproportionate numbers of delayed police responses to those neighborhoods with higher minority populations, according to the American Civil Liberties Union of Illinois and a community group from the West side Austin neighborhood. The ACLU of Illinois and the Central Austin Neighborhood Association (CANA) today filed a lawsuit in Cook County court asking the City to deploy police officers more equitably to serve all communities across Chicago. The ACLU of Illinois' membership includes persons in the Austin neighborhood as well as all of the other underrepresented districts. The lawsuit follows a host of recent coverage abo...

  • CHICAGO, June 7, 2011 /PRNewswire-USNewswire/ -- Following years of inaction by state governmental officials, the American Civil Liberties Union of Illinois today filed an administrative complaint and asked the U.S. Department of Justice to launch an investigation into the substantial racial disparate impact cause by consent searches conducted by Illinois State Police troopers of Hispanic and African American motorists. Data collected and reported over the past several years demonstrate that ISP troopers are more likely to ask Hispanic and African American motorists for consent to search their vehicles, but are more likely to find contraband when consent searching a car driven by a Caucasian motorist. A consent search occurs when a police officer does not have legally sufficient cause t...
