Relator, William Hamilton, filed a petition for a writ of mandamus asking this Court to order Respondent, Judge Richard O’Neill, to rule on Relator’s motion which has been pending before the Respondent for over eleven months. Initially, we issued an alternative writ requesting the Respondent to show cause why a writ of mandamus should not issue. Respondent failed to respond to our request. We conclude that the requirements for a writ of mandamus are met and thus grant Relator’s petition and order the Respondent to rule on the pending motion.

Petitioner sought an order from this Court directing Judge Wolaver to recuse himself from a civil matter in which Petitioner was involved. After J. Wolaver’s recusal, Petitioner was ordered to show cause why the petition should not be dismissed as moot. In his response to our show cause order, Petitioner failed to present any claim which met the requirements for either a writ of mandamus or a writ of prohibition.
