A pilot alternative dispute resolution program in Western New York federal courts will be expanding into the Rochester area.
The program, started by Chief Judge William M. Skretny before he was chief judge, has been running in the Buffalo region of the 17- county U.S. District Court for the Western District of New York since Jan. 1, 2006.

The U.S. Nuclear Regulatory Commission (NRC) is expanding the scope of the post-investigation Alternative Dispute Resolution (ADR) Program for a 1-year pilot period. The NRC and its licensees are the parties to this form of ADR. Currently, post-investigation ADR is used in the NRC's Enforcement Program for cases involving discrimination and other wrongdoing after the NRC's Office of Investigations has completed an investigation substantiating the allegation. The pilot ADR Program will expand post-investigation ADR to include all escalated non-willful (traditional) enforcement cases with proposed civil penalties (this will not include violations associated with findings assessed through the Reactor Oversight Process (ROP) \1\). ------------------------------------------------------------...

Alternative dispute resolution - which includes mediation, arbitration and other procedures designed to settle disputes without a trial - has grown steadily over the past two decades, and is booming in an era of cost cutting. "The court system has put a greater emphasis on ADR over the past 10 to 15 years, and it has become more widely available," said Daniel Weitz, ADR coordinator for the New York State Unified Court System.
Courts in Long Island now have ADR programs available for various areas of the law, including family, civil and commercial. The courts feature rosters of approved mediators and arbitrators, while private firms comprised of mediators and arbitrators - some of whom are former judges - have sprouted to provide another option.

This article addresses selected recent developments relating to the use of Alternative Dispute Resolution (ADR) in the energy industry from January 2008 through January 2009. The US Department of Energy (DOE) defines ADR as "[A]ny technique for resolving disputes without resorting to litigation in either an administrative or judicial forum." Towards this end, the DOE maintains the Office Of Conflict Prevention and Resolution, which is tasked with providing "advice and support for ADR initiatives" throughout the DOE, as well as consultation on "resolving disputes and cases in litigation."
