Charles Schaffran said he was discharged at Alliance Bernstein Investment Research in violation of Sarbanes-Oxley Act Section 806(a) because he cooperated in an SEC investigation of the company. Alliance argued that Schaffran resigned. Schaffran commenced National Association of Securities Dealers arbitration proceedings and Alliance responded by filing a declaratory judgment action in court. The 2nd Circuit stated: When parties explicitly incorporate rules that empower an arbitrator to decide issues of arbitrability, incorporation serves as clear and unmistakable evidence of the parties' intent to delegate such issues to an arbitrator.

The Commodity Futures Trading Commission (``Commission'' or ``CFTC'') is adopting rules to implement new statutory provisions enacted by Title VII of the Dodd-Frank Wall Street Reform and Consumer Protection Act. These rules address: The documentation between a customer and a futures commission merchant that clears on behalf of the customer; the timing of acceptance or rejection of trades for clearing by derivatives clearing organizations and clearing members; and the risk management procedures of futures commission merchants, swap dealers, and major swap participants that are clearing members. The rules are designed to increase customer access to clearing, to facilitate the timely processing of trades, and to strengthen risk management at the clearing member level.

WASHINGTON - Three more large investment firms have raised sufficient capital to participate in the joint partnership with the government to purchase toxic assets from banks.
The Treasury Department said Alliance Bernstein LP and BlackRock Inc., both headquartered in New York City, and Wellington Management Co., based in Boston, had all raised the $500 million minimum to begin operations.

Many self-indulgent parents are choosing plasma televisions and cruises over English 101. A study released Monday reveals that 74 percent of parents of college-bound students conceded they could be "saving significantly more for their children's education" if they curtailed luxury spending.
The survey from investment company Alliance Bernstein found that 58 percent of the parents spent more on eating out in the past year than they had squirreled away for junior's tuition. Also, 49 percent also spent more on vacations and 38 percent spent more on fancy consumer electronics than they put toward college savings. About 87 percent said they were relying on scholarships or grants, and 58 percent "will hold their children accountable" for at least some of the education costs.
