In early June, the U.S. Supreme Court decided a case of historic dimensions. With Boumediene v. Bush, decided by a 5-4 majority, the court has decided to get much more deeply into how wars are run.
The case stands for the proposition that an alien enemy combatant, captured abroad while trying to kill Americans in the war on terror, whether held in the United States or elsewhere, is entitled to a habeas corpus hearing before a U.S. federal judge. Habeas corpus is the traditional right of all Americans to challenge their detention by the government. As I will explain later, this is absolutely amazing - an astonishing act of judicial hubris and a terrible decision.

Sen. Lindsey Graham, South Carolina Republican, deserves a salute. On Nov. 10, he engineered an amendment to a pending bill that generally ends the absurdity of alien enemy combatants detained at Guantanamo Bay (GTMO) suing in federal courts officials of the United States they hope to kill.
Under existing habeas corpus statutes as interpreted by the Supreme Court in Rasul v. Bush (2004), some 300 GTMO detainees have sued alleging various transgressions of constitutional rights, including a demand for dictionaries, high-speed internet access, and faster mail delivery.
