• Are the roots of the modern 'lex mercatoria' really medieval?

The present 'lex mercatoria' is a group of rules of conduct for international trade developed individually by international businesses. An investigation of commerce between the 10th and 13th centuries revealed that, as most exchanges are simultaneous, distinctions between law codes did not present a serious problem and that mercantile guilds arose not to give institutions something similar to the modern 'lex mercatoria' but to provide physical security.
